Limitation of Liability

Notwithstanding any provision of this Agreement, to the maximum extent permitted by applicable law, in no event will the Provider be liable for any indirect, special, incidental or consequential damages arising out of the use of or inability to use the Products/Services, including, without limitation, damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses SUCH AS LOST PROFITS, LOSS OF EARNINGS, FINANCIAL LOSS, LOSS OF BUSINESS OPPORTUNITIES, PERSONAL INJURY OR ANY OTHER LOSS OR DAMAGES HOWEVER CAUSED, RUSULTING, DIRECTLY OR INDIRTECTLY, or IN CONNECTION WITH THIS AGREEMENT or THE PRODUCTS/SERVICES, even if advised of the possibility thereof.

The Provider's entire liability under any provision of this Agreement shall not exceed in the aggregate the sum of the consideration received under this Agreement for the 12 months period immediately preceding the date of the facts on which such claim is based. THE PROVIDER IS NOT LIABLE FOR ACTS OR OMISSIONS FOF ANY OTHER SERVICE PROVIDER (INTERNET PROVIDERS OR OTHER TELECOMMUNICATION CARRIERS) FOR PROGRAM FAILURE, NETWORK FAILURE, OR MODIFICATION of INFORMATION OR DATA PROVIDED THROUGH THE PROVIDER.S SERVICES OR FOR CAUSES BEYOND THE REASONABLE CONTROL OF THE PROVIDER. THE PROVIDER IS NOT LIABLE FOR THE ACCURACY OF THE INFORMATION POSTED ON ITS WEBSITE BY THE SUPPLIER OR BY CUSTOMERS.
